Puppy Contract

Seller and Buyer agree as follows:

1. DESCRIPTION OF DOG
The dog sold pursuant to the terms of this agreement is as follows:

Herein referred to as Puppy

2. LIMITATION OF CONTRACT
This contract applies to the original Puppy and original Buyer ONLY and is non-transferable to a second party.

3. SELLER’S REPRESENTATION
____ a. As of the date of this agreement, Puppy is in good health and free of communicable diseases and parasites.
____ b. Buyer has three days (72 hours) in which to have Puppy examined by a licensed veterinarian to certify the health of Puppy. Buyer may return Puppy to Seller along with a written veterinary certification for a full refund of the purchase price if Puppy is found to be unfit.

4. BUYER’S REPRESENTATION
____ a. Puppy is being sold for the sum of $________ to be paid in full prior to or at time of transfer of Puppy from Seller to Buyer.
____ b. Buyer is completely satisfied with and waives any and all claims regarding the Puppy’s conformation and outward appearance.

5. HEALTH & TEMPERAMENT
____ a. Seller guarantees that Puppy is in good health and has received appropriate timely medical care, including, a veterinary health exam, inoculations, etc.
____ b. Seller shall not be held responsible for acts of Puppy or any injury to Puppy after Puppy leaves Seller’s premises.
____ c. Seller shall not be held responsible for the development of non-genetically derived faults, diseases, or disorders after Puppy leaves Seller.
____ d. Any surgeries performed on Puppy, including ear cropping, resulting in death or an incapacitating condition, shall be the sole responsibility of Buyer.
____ e. In the event that a genetic defect is found which develops to the extent that Puppy dies or must be euthanized before reaching two years in age, Seller will replace Puppy with a male/female of like value from the next available litter. If no replacement puppy is available within one year, Seller will refund half of the purchase price of Puppy. The licensed veterinarian who finds such genetic defect will be required to provide a written report of the defect and be available to discuss the report with Seller's veterinarian.
This health guarantee is null and void if Buyer does not complete the veterinary exam within 72 hours of transfer of Puppy from Seller to Buyer (3b).

6. MAINTENANCE
____ a. Buyer agrees to maintain Puppy in good health, socialized and to provide routine preventative health care, including but not limited to the following:
        • annual physical exams by a licensed veterinarian and appropriate vaccinations, parasite control and health screenings where applicable.
        • proper exercise and diet in order to maintain Puppy in optimal weight and condition.
        • proper socialization.
____ b. Buyer agrees not to begin strenuous exercise and physical training with Puppy until Puppy has reached a minimum age of one year.
____ c. Buyer agrees to raise Puppy in their home as part of their family. Never will Puppy be chained or tied up outside. When Puppy is outside, it shall only be in reasonable weather and within an enclosed area or under supervision. Buyer realizes that Great Danes are indoor family dogs and will not be happy if left alone for extended periods of time.

7. MISCELLANEOUS
____ a. Buyer shall provide Puppy with humane care and maintain Puppy in accordance with all current and future state, county, and municipal laws and ordinances where Buyer resides or will reside. If it is reported and confirmed that Puppy is being abused or neglected, Buyer's rights and ownership of Puppy will automatically terminate and revert back to Seller who may immediately assume possession of Puppy. Buyer will be responsible for Seller’s fees and costs involved with the repossession. If Puppy requires medical attention and treatment, all costs involved will be Buyer’s responsibility.
____ b. If at any time during the lifetime of Puppy Buyer is no longer able to keep Puppy, Buyer grants Seller right of first refusal to take possession of Puppy. Seller shall have five (5) working days after receipt of written offer to exercise this option. Transfer back to the Seller shall be accompanied by the appropriate AKC registration papers properly endorsed by the Buyer, along with medical information concerning Puppy.
____ c. Buyer agrees that neither he/she nor the Buyer's estate/executors may sell, give, or otherwise transfer ownership of Puppy without Seller's knowledge and written consent. Buyer must give Seller right of first refusal (7b). Under NO circumstances shall Puppy be taken to an animal shelter, humane society, or released to a rescue group. Puppy shall not be surrendered to any animal testing facility.
____ d. Buyer and Seller agree to notify each other of any changes of address during Puppy's lifetime.
____ e. Buyer and Seller recognize Mount Pleasant in Charleston County, South Carolina as the place where this agreement was entered into, and acknowledge the courts in Charleston County, South Carolina as the court of jurisdiction should any disputes arise from this agreement.

8. LIQUIDATED DAMAGES
____ a. If Buyer breaches Right of First Refusal (7b) or otherwise improperly surrenders Puppy to another person (7c) Buyer will pay liquidated damages to Seller in the amount of five thousand dollars ($5,000.00).
____ b. Puppy is registered with the AKC ~ American Kennel Club. This is the only acceptable registration other than the Canadian Kennel Club or a Foreign Kennel club if the Puppy is sold out of this Country (USA). If this Puppy is ever registered with a non-acceptable group such as the Continental Kennel Club without written consent from Seller, this contract/agreement is null and void except where penalties for improperly registering a Puppy apply. Buyer will pay liquidated damages to Seller in the amount of two thousand dollars ($2,000) for any inappropriate registry of the Puppy.

By signing below, Seller and Buyer declare that they have read and understand and agree to the above stipulations.
